A lawsuit against Austin's Crux Climbing Gym was dismissed, and the public relations firm for the gym said they will move its location to another area in south Austin, according to a statement from the owner obtained by KXAN.

Crux Climbing Gym lawsuit dismissed, new location announced

AUSTIN (KXAN) -- A lawsuit against Austin's Crux Climbing Gym was dismissed, and the public relations firm for the gym said they will move its location to another area in south Austin, according to a statement from the firm obtained by KXAN.

Back in December, the gym faced a civil lawsuit from the building's landlord, 3432 Pickle LLC. The lawsuit said Crux's claim the climbing walls were "trade fixtures" and were erroneous. The landlord went on to say it was seeking a declaration the climbing walls were its property.

Crux Chief Operation Officer Grace Nicholas said they were fighting the accusations.

A commercial broker with McAllister and Associates said trade fixtures are usually spelled out in the initial lease agreement but said it could become a gray area.

“Trade fixtures would be like the sign of the business that is renting out front or like specific shelving,” the broker said. “If it does cause serious changes to the property and you don’t have it spelled out within the lease, that’s when you’ll have to get a lawyer involved.”

In the statement provided to KXAN Friday, the firm said the lease ended, and they were moving out. However, that isn't stopping the gym from going on to its next endeavor: a new location.

The gym also opened another location on Dec. 13 in Pflugerville, which features 58-foot-tall climbing walls, a dedicated fitness studio and more.
