Berne sues governor over lack of town board appointment
The town of Berne is suing Gov. Kathy Hochul on the claim she has ignored repeated requests to fill empty seats on the town board.
BERNE, N.Y. (NEWS10) -- The town of Berne is suing Gov. Kathy Hochul on the claim she has ignored repeated requests to fill empty seats on the town board. The board has not met since August after three of the five members resigned.
The town said state law gives the governor authority to appoint board members. According to court documents, the town has made repeated requests for the governor to appoint one member. The town said that would allow the board to resume meetings until a special election can be held.
The mayor previously told NEWS10 the town can keep functioning without a board. The town is operating off last year's budget.
A spokesperson for the governor said, "While we cannot comment on pending litigation, an appointment is under consideration."
